Terms of Service

1. The service

Pakka is a software platform for interior and design-build firms, with Sales, Design, Money and Ops desks, a web app at app.pakka.work and features that work through WhatsApp. We are adding and improving features continuously, and some features may change.

2. Accounts

• You must give accurate details and keep your login secure. You are responsible for activity under your firm's account and for the people you invite.
• The person who creates the firm's account confirms they are allowed to accept these terms for the firm.
• We set up every firm ourselves, so access is granted in stages: applying does not guarantee access.

3. Your data

• Your firm owns the data it puts into Pakka. You give us permission to store and process it only to provide and improve the service, as described in the Privacy Policy.
• You are responsible for having the right to add your team's, clients' and vendors' details and for telling them how you use Pakka, including that messages to Pakka's WhatsApp number are recorded.
• You can export your data while your account is active and for 30 days after it closes.
• If you connect your firm's WhatsApp Business number, you confirm you own or control it, you choose which messages Pakka sends from it, and you have your clients' agreement to receive them. You can disconnect it at any time.

4. Using Pakka properly

• Do not use Pakka for anything unlawful, to send spam, or to message people who have not agreed to hear from you.
• Follow WhatsApp's and Meta's policies when using the WhatsApp features.
• Do not try to break, copy, resell or reverse engineer the service, or access other firms' data.
• Respect opt-outs. When someone asks not to be messaged, Pakka stops automatic messages to them and you must not message them through Pakka.

5. AI features

AI features draft suggestions such as quote lines, task summaries and answers from drawings. They can be wrong. You are responsible for reviewing them: Pakka is designed so that a person confirms anything that moves work or money, and the AI never sets prices.

6. Payments between you and others

Pakka helps you track and approve payments between your firm, your clients and your vendors. Pakka never holds, receives or moves those funds and is not a bank, payment service or escrow. Payments are made from your own accounts, and you are responsible for them. Nothing in Pakka is legal, tax or financial advice.

7. Founding firms programme

• Firms selected for the founding programme get their first project on Pakka free of charge.
• In return, the firm agrees to share honest feedback, including a short weekly call during the project.
• A case study or review is voluntary: we publish your firm's name or details only with your written consent.
• Firms that join the founding programme by 31 December 2026 keep the founding price for as long as they remain customers, on the terms published with our prices.

8. Fees

Pakka does not charge any firm today. We will publish prices and billing terms in January 2027 and give existing users at least 30 days' notice before any charge. Nothing will be charged without your agreement to those terms.

9. Our intellectual property

Pakka's software, design and content belong to Ensemblon Automation Design and Entertainment Private Limited. We give your firm a right to use the service under these terms. If you send us feedback, we may use it to improve Pakka without obligation to you.

10. Confidentiality

We keep your firm's data confidential and use it only to provide the service. You keep confidential any non-public information about Pakka that we share with you, such as features in testing.

11. Availability

We work to keep Pakka available and your data safe, but the service is provided "as is" while it is in early access, without guarantees that it will be uninterrupted or error-free. We will tell you in advance about planned changes that significantly affect how you use it.

12. Liability

To the extent the law allows, Pakka is not liable for indirect or consequential losses, such as lost profit or lost business, and our total liability to your firm for any claim is limited to the fees your firm paid Pakka in the 12 months before the claim, or ₹10,000 if no fees were paid. Nothing here limits liability that cannot be limited by law.

13. Ending the agreement

• You can stop using Pakka and close your account at any time.
• We may suspend or close an account that breaches these terms, after notice where reasonable.
• After closure you have 30 days to export your data, after which we delete it as described in the Privacy Policy.

14. Law and disputes

These terms are governed by the laws of India. We will first try to resolve any dispute by talking. If that fails, the courts in Bengaluru, Karnataka have exclusive jurisdiction.

15. Changes

We may update these terms. We will post the new version here with a new date and email account holders about material changes. Questions: start@pakka.work.
